Judgment in the application brought by the state to make amendments to the indictment containing the charges against rape and human trafficking accused Timothy Omotoso will be heard on Monday.
On Friday, the Port Elizabeth high court heard final submissions from the state and defence in the application, after Omotoso was denied bail for the third time.
The state has requested to make changes to at least eight counts against Omotoso and his co-accused Lusanda Sulani, 37, and Zukiswa Sitho, 29.
They face 63 main and 37 alternative charges, including rape, human trafficking, sexual assault and racketeering.
On Thursday, prosecutor Zukile Mdolomba asked that the state be allowed to make the amendments, which include adding further dates and places of when and where the alleged offences took place.
Attorney Peter Daubermann, for Omotoso and his co-accused, opposed the application, claiming it would be tantamount to adding additional charges against his clients.
Judge Irma Schoeman postponed the matter to Monday for judgment.
Omotoso has been in custody since his April 2017 arrest at the Port Elizabeth International Airport, while Sulani and Sitho are out on bail of R2,000 each.
In October, Omotoso brought an application for bail based on new facts, however, it was dismissed after the court ruled that no new facts were presented and there were no exceptional circumstances to release him.
Omotoso then brought an application for leave to appeal the decision not to grant him bail, which was also dismissed.
The main trial is expected to resume next week.
